MenuIQ, LLC, a Delaware limited liability company ("MenuIQ," "we," "us," or "our"), is committed to protecting your privacy. This Privacy Policy describes how we collect, use, disclose, and safeguard your personal information when you use the MenuIQ restaurant platform and related services (collectively, the "Services").

PLEASE READ THIS PRIVACY POLICY CAREFULLY. By accessing or using the Services, you acknowledge that you have read, understood, and agree to be bound by this Privacy Policy.

1. INFORMATION WE COLLECT

1.1 Personal Information You Provide

Account Information:

  • Email address

  • Password (stored as a secure hash using bcrypt; we never store passwords in plain text)

  • Restaurant name and details

User-Generated Content:

  • Menu images, item descriptions, and pricing you upload

  • Customer support communications

IMPORTANT NOTE ABOUT HEALTH DATA: Any allergen or dietary preference information you associate with menu items is treated with heightened security and only used to provide the Services.

1.2 Information Collected Automatically

  • Device type and operating system

  • Usage patterns and session duration

  • IP address (used for fraud prevention)

  • Error logs and crash reports

1.3 Special Note About Menu Images

Menu images you upload are handled as follows:

  • Images may be transmitted to our AI processing provider (Anthropic) for analysis

  • Processed images are stored on Cloudflare R2 for your menu management

  • Menu images are NOT used to train AI models

2. HOW WE USE YOUR INFORMATION

  • Provide menu management and AI extraction services

  • Authenticate your identity and prevent unauthorized access

  • Manage your restaurants and subscription

  • Send transactional emails (account verification, password reset)

  • Respond to customer support inquiries

  • Comply with legal obligations

3. HOW WE SHARE YOUR INFORMATION

We do not sell, rent, or trade your personal information. We may share with:

Anthropic, PBC (AI Processing): Menu images for real-time analysis only.

Railway Corporation (Cloud Hosting): Account information for server infrastructure.

Cloudflare (Media Storage): Menu images and assets for delivery.

Payment Processors (Stripe): Transaction data for subscriptions. We never receive your full payment credentials.

We do NOT:

  • Sell your personal information

  • Share information for third-party marketing

  • Use your information for targeted advertising

4. ARTIFICIAL INTELLIGENCE AND MACHINE LEARNING

  • Your menu images are NOT used to train AI models

  • Anthropic has committed not to use API data for model training

  • AI-powered extraction and allergen detection are NOT 100% accurate — always review AI output before publishing

5. HOW WE PROTECT YOUR INFORMATION

  • All data in transit uses TLS 1.2+

  • Passwords stored using bcrypt hashing with salt

  • Role-based access control for team members and employees

  • Regular security testing and vulnerability scanning

6. HOW LONG WE RETAIN YOUR INFORMATION

  • Account data: Retained for the duration of your account; deleted within 30 days of account deletion request

  • Menu data: Retained until you delete it or close your account

  • Transaction records: Retained for 7 years for legal compliance

7. YOUR PRIVACY RIGHTS

You have the right to:

  • Access a copy of your personal information

  • Correct inaccurate information

  • Delete your personal information

  • Export your menu data

8. CALIFORNIA PRIVACY RIGHTS (CCPA/CPRA)

California residents have the right to know what personal information we collect, request deletion, and opt out of the sale of personal information. We have not sold personal information in the preceding twelve (12) months and do not intend to do so.

9. EUROPEAN PRIVACY RIGHTS (GDPR)

If you are located in the EEA, UK, or Switzerland, we process your personal information based on:

  • Performance of a Contract: To provide the Services

  • Legitimate Interests: For fraud prevention and service improvement

  • Consent: For marketing communications (can be withdrawn at any time)

10. CHILDREN'S PRIVACY

The Services are not directed to children under 13. We do not knowingly collect personal information from children under 13.

11. CHANGES TO THIS PRIVACY POLICY

We may update this Privacy Policy from time to time. We will notify you of material changes via email or prominent notice in the Services at least 30 days before changes take effect.
